Terms of Use

These Terms of Use (hereinafter referred to as "Terms") stipulate the terms and conditions for using the digital content service (hereinafter referred to as "Service") provided by Kurobe Corporation (hereinafter referred to as "Company") on this website. Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Article 1 (Application)

These Terms shall apply to all matters related to the use of the Service between the user and the Company.
In addition to these Terms of Use, the Company may establish various rules and regulations (hereinafter referred to as "Individual Provisions") regarding the use of the Service. Regardless of their names, these Individual Provisions shall constitute a part of these Terms of Use. In the event of any conflict between the provisions of these Terms of Use and the provisions of the Individual Provisions, the provisions of the Individual Provisions shall take precedence unless otherwise specified in the Individual Provisions.

Article 2 (User Registration)

In this service, registration applicants shall agree to these Terms of Use and apply for registration using the method specified by the Company. Registration shall be completed upon approval by the Company. The Company may refuse to approve a registration application if it determines that any of the following circumstances apply to the applicant, and shall not be obligated to disclose the reasons for such refusal.

  1. If false information is provided in the application for registration

  2. If the application is from a person who has violated these Terms of Use

  3. If we determine that registration is otherwise inappropriate

Article 3 (Management of User ID and Password)

Users shall manage their user IDs and passwords for this service appropriately at their own risk.
Under no circumstances may users transfer or lend their user IDs and passwords to third parties, or share them with third parties. The Company shall deem that a user ID has been used by the registered user when the combination of user ID and password matches the registered information and the user logs in.


The Company shall not be liable for any damage caused by the use of the user ID and password by a third party, except in cases of intentional or gross negligence on the part of the Company.

Article 4 (Usage Fees and Payment Methods)

Users shall pay the usage fees separately determined by the Company and displayed on this website as consideration for the paid portion of this service, using the payment method specified by the Company.

Article 5 (Use of Downloaded Content)

Provided content downloaded to a user's device may only be used on the device on which it was downloaded.

Article 6 (Attribution of Rights)

All intellectual property rights related to this service and the content provided within this service belong to our company or those who have granted us a license.

Article 7 (Prohibited Matters)

Users shall not engage in the following acts when using this service:

  1. Acts that violate laws and regulations or public order and morals

  2. Acts related to criminal activities

  3. Acts that infringe on intellectual property rights, such as copyrights and trademark rights, contained in this service

  4. Acts that destroy or interfere with the functions of our servers or networks, those of other users, or those of other third parties  

  5. Acts that commercially utilize information obtained through this service  

  6. Acts that may interfere with the operation of our services  

  7. Acts of unauthorized access or attempts thereof  

  8. Acts of collecting or accumulating personal information about other users

  9. Acts of using this service for improper purposes

  10. Acts that cause disadvantage, damage, or discomfort to other users or third parties of this service

  11. Acts of impersonating other users

  12. Acts of advertising, soliciting, or conducting business activities on this service without our permission

  13. Acts aimed at meeting strangers of the opposite sex

  14. Acts of directly or indirectly providing benefits to antisocial forces in connection with our services

  15. Other acts that we deem inappropriate

Article 8 (Suspension of Service Provision, etc.)

The Company may suspend or interrupt the provision of all or part of the Service without prior notice to users if it determines that any of the following circumstances apply.  

  1. When performing maintenance or updates on the computer system related to the Service

  2. When the provision of the Service becomes difficult due to force majuere such as earthquakes, lightning strikes, fires, power outages, or natural disasters

  3. When computers or communication lines are shut down due to accidents

  4. When we determine that the provision of the Service is difficult for other reasons

We shall not be liable for any disadvantage or damage suffered by users or third parties as a result of the suspension or interruption of the provision of the Service.

Article 9 (Restrictions on Use and Cancellation of Registration)

The Company may, without prior notice, restrict the user's access to all or part of the Service or cancel the user's registration if the user falls under any of the following categories:

  • Violation of any provision of these Terms of Service

  • Discovery of false information in registration details

  • Failure to pay fees or other charges

  • Failure to respond to contact from us within a specified period

  • No use of the Service for a specified period following the last use

  • Other circumstances where we determine the user's use of the Service is inappropriate

We shall not be liable for any damages incurred by the user as a result of actions taken by us pursuant to this Article.

Article 10 (Withdrawal)

Users may withdraw from this service by following the withdrawal procedure specified by the Company.
The Company may retain and use information provided by users even after they have withdrawn from the service.
The Company may, at its discretion and without prior notice, delete user information that has not been accessed for more than one year.
Users shall not be relieved of any obligations or liabilities (including, but not limited to, damages) under this Terms of Use to us or third parties even after withdrawal.

Article 11 (Disclaimer of Warranty and Exemption from Liability)

The Company does not expressly or implicitly guarantee that the Service is free from factual or legal defects (including defects, errors, bugs, or infringements related to safety, reliability, accuracy, completeness, validity, suitability for specific purposes, security, etc.).
We shall not be liable for any damages incurred by users as a result of this service, except in cases of intentional misconduct or gross negligence on our part. However, if the contract between us and the user regarding this service (including these Terms of Use) constitutes a consumer contract as defined by the Consumer Contract Act, this disclaimer shall not apply.
Even in the case specified in the preceding paragraph, we shall not be liable for any damages incurred by users due to our negligence (excluding gross negligence) resulting from breach of contract or tort, including damages arising from special circumstances (including cases where we or the user foresaw or could have foreseen the occurrence of such damages). Furthermore, compensation for damages incurred by the user due to our breach of contract or tortious act caused by our negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the user in the month in which the damage occurred.
We shall not be liable for any transactions, communications, or disputes arising between the user and other users or third parties in connection with this service.

Article 12 (Changes to Service Content, etc.)

The Company may change, add, or discontinue the contents of this service after giving prior notice to users, and users shall agree to this.

Article 13 (Changes to Terms of Use)

The Company may amend these Terms of Use without requiring the individual consent of users in the following cases.

  1. When the amendment to these Terms of Use is in the general interest of users.

  2. When the amendment to these Terms of Use does not conflict with the purpose of the Service Use Agreement, and when the amendment is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other circumstances related to the amendment.

The Company shall notify users in advance of any amendment to these Terms of Use pursuant to the preceding paragraph, including the fact that these Terms of Use will be amended, the content of the amended Terms of Use, and the effective date of the amendment.

Article 14 (Handling of Personal Information)

Our company will handle personal information obtained through the use of this service appropriately in accordance with our "Privacy Policy".

Article 15 (Notification or Contact)

Notifications or communications between users and our company shall be made in accordance with the methods specified by our company. Unless users notify us of changes in accordance with the procedures specified separately by our company, we will consider the currently registered contact information to be valid and will send notifications or communications to that contact information, which will be deemed to have reached the user at the time of dispatch.

Article 16 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer their status under the usage agreement or their rights or obligations under these Terms of Use to a third party, or use them as collateral, without our prior written consent.

Article 17 (Severability)

The Company may change, add, or discontinue the contents of this service after giving prior notice to users, and users shall agree to this.

Article 18 (Measures for Violations of the Terms of Use)

We may, at our discretion and without prior notice, take measures such as temporarily suspending or restricting the use of the Service, deleting accounts, or terminating this User Agreement (hereinafter referred to as "Suspension of Use") against any user who we determine to fall under any of the following items or who we determine to be likely to fall under any of the following items.

  1. Violation of any provision of these Terms of Use  

  2. If the user is determined by us to be a member of an antisocial group or to be cooperating with or involved in the maintenance, operation, or management of such a group through funding or other means, or to be engaged in any other form of interaction or involvement with such a group  

  3. If we determine that it is necessary for the operation or maintenance of the Service

  4. If the Company determines that there are other reasons similar to those listed above  

The Company shall not be liable for any damages incurred by the user as a result of the suspension of use measures specified in the preceding paragraph.

Article 19 (Governing Law and Jurisdiction)

Japanese law shall govern the interpretation of these Terms of Use.
In the event of any dispute arising in connection with the Services, the Yokohama District Court shall have exclusive jurisdiction over the matter.

[Supplementary Provisions] These Terms and Conditions shall come into effect on November 1, 2022.
